Article 8
Competences and aid application procedures
1. Submission of applications seeking eligibility for grant and
interest subsidy and/or leasing subsidy.
(a) Subject to the provisions of instances (c) and (d) below, applications
seeking eligibility of investments and/or equipment leasing programs
or rescue and re-structuring business plans shall be submitted from
January 1st to September 15th as follows:
(1) Applications seeking eligibility of investments and/or equipment
leasing programs over Drs. 1.2 bil-lion implemented within the region
of Eastern Mace-donia and Thrace, as well as investments or programs
over Drs. 700 million implemented in the rest of Greece shall be
submitted to the Central Office of the Ministry of National Economy.
Equally, regardless of amount, investments in and/or programs for
confer-ence, thalassotherapy, health tourism, ski and train-ing-sports
tourism centres, marinas, golf courts and spa facilities under instance
(t) of para. 1, article 3, joint venture centres of instance (p)
of that paragraph, international trade companies under instance
(q) of that paragraph, undertakings producing electricity from mild
forms of energy under instance (b) of that paragraph, undertakings
operating means of transpor-tation of people and cargo under instance
(o) of that paragraph, as well as undertakings implementing in-vestments
abroad under para. 2 of article 3 shall be submitted to the same
Central Office. Finally, rescue and restructuring business plans
under para. 2 of arti-cle 10, regardless of amount, shall also be
submitted to the Central Office of the Ministry of National Econ-omy.
Other categories of undertakings which shall submit applications
seeking eligibility for aids regard-less of amount to the Central
Office of the Ministry of National Economy shall be defined by virtue
of deci-sion of the Minister of National Economy.
(2) Applications seeking eligibility of investments and/or equipment
leasing programs of up to Drs. 700 million implemented within each
Region, or of up to Drs. 1.2 billion in the case of Eastern Macedonia
and Thrace, subject to the provisions of sub-instances (1) and (3),
shall be submitted to the Private Investments Departments of the
Regional Authorities. In particular, applications seeking eligibility
of investments and/or programs of up to seven hundred (700,000,000)
mil-lion drachmas implemented within the Department of the Dodecanese,
shall be submitted to the Regional Development Office of the Dodecanese
of the South Aegean Region.
(3) Applications seeking eligibility of investments and/or leasing
programs of craft industry equipment of up to Drs. 200 million implemented
within the Region of Attica, shall be submitted to the Hellenic
Organisa-tion for Small and Medium Size Enterprises and Handicraft
Undertakings (EOMMEX).
(4) Applications seeking eligibility of investments and/or equipment
leasing programs in excess of Drs. 3.0 billion, as well as investments
or business plans in excess of Drs. 1.0 billion, provided that at
least 50% of own participation comes from foreign capital, shall
be submitted to the Hellenic Centre for Investment S.A. (ELKE).
Three copies of the file shall then be dis-patched from ELKE to
the Ministry of National Econ-omy, where it shall be determined
whether such appli-cation shall be eligible for the provisions of
these pre-sents.
(b) The limits of the sub-instances (1), (2), (3) and (4) above
may be readjusted by virtue of decision of the Minister of National
Economy.
(c) Applications seeking eligibility of business plans, under sub-instance
(xv) of instance (a), sub-instance (v) of instance (e) and sub-instance
(xii) of instance (g) of para. 1, article 3, in excess of Drs. 3.0
billion, as well as of business plans in excess of Drs. 1.0 billion,
provided that at least 50% of own participation comes from foreign
capital, shall be submitted to the Hellenic Centre for Investment
S.A. (ELKE), in January of each year. Three copies of the file shall
then be dispatched from ELKE to the General Secretariat for Industry
of the Ministry of Development, where it shall be deter-mined whether
such application shall be eligible for the provisions of these presents.
Such applications shall be submitted to ELKE pursuant to a call
for ex-pression of interest under instance (d) below.
Additionally, applications seeking eligibility of in-vestments,
under sub-instances (xvii), (xviii), (xx) and (xxi) of instance
(a), as well as of investments under instance (f) of paragraph 1,
article 3, in excess of Drs. 3.0 billion, and investments or business
plans in ex-cess of Drs. 1.0 billion, provided that at least 50%
of own participation comes from foreign capital, shall also be submitted
to the Hellenic Centre for Invest-ment S.A. (ELKE) in January of
each year. Three cop-ies of the file shall then be dispatched from
ELKE to the General Secretariat for Industry of the Ministry of
Development, where it shall be determined whether such application
shall be eligible or not for the provi-sions of these presents.
(d) Applications seeking eligibility of business plans, under sub-instance
(xv) of instance (a), sub-instance (v) of instance (e) and sub-instance
(xii) of instance (g) of para. 1, article 3, of up to Drs. 1.0 billion
or from Drs. 1.0 to 3.0 billion, provided that own participation
does not comes from foreign capital or that foreign capital represents
less than 50%, shall be submitted to the General Secretariat for
Industry of the Ministry of Development, in January of each year.
Such appli-cations shall be submitted pursuant to a relevant call
for expression of interest, following joint decision of the Ministers
of National Economy and Development, which shall be issued in the
last 15 days of September and widely published in the financial
press.
Additionally, applications seeking eligibility of in-vestments,
under sub-instances (xvii), (xviii), (xx) and (xxi) of instance
(a), as well as of investments under instance (f) of para. 1, article
3, of up to Drs. 1.0 billion or from Drs. 1.0 to 3.0 billion, provided
that own par-ticipation does not comes from foreign capital or that
foreign capital represents less than 50%, shall also be submitted
to the General Secretariat for Industry of the Ministry of Development,
in January of each year.
(e) Applications seeking eligibility of investments and/or leasing
programs, coming under special aid statuses under para. 1, article
10, shall be submitted to the Central Office of the Ministry of
National Econ-omy or the competent Private Investments Depart-ments
of the Regional Authorities, as stipulated by the relevant presidential
decrees establishing them, and within the time limits also set therein.
